1. Definitions

• "Seller" refers to KKHS Media (kkhsmedia.com)
• "Buyer" / "Customer" refers to the person making the purchase
• "Product" refers to the digital source code, scripts, or software sold
• "Service" refers to installation support, setup packages, or customization work

2. Nature of Product

All products sold on this website are digital source code provided "as-is" at the time of purchase. The source code is a development tool/framework that requires technical knowledge or professional assistance to deploy, configure, and maintain.

• The product is delivered as a downloadable ZIP file containing source code
• The product is NOT a hosted/managed service — it is source code that you deploy on your own server
• The buyer is responsible for their own hosting, domain, SSL, server maintenance, and security

3. License Grant

• Upon purchase, you receive an unlimited-domain license — you may install and use the source code on as many domains/servers as you wish
• You may modify the source code for your own use or your clients' use
• You may resell/white-label the installed product to your clients as a service
• You may NOT redistribute, resell, or share the raw source code files as-is to others
• You may NOT upload the source code to public repositories (GitHub, GitLab, etc.)
• You may NOT claim original authorship of the source code

5. Limitation of Liability

Under no circumstances shall KKHS Media be liable for any:

• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from the use or inability to use the product
• Damages caused by third-party services (WhatsApp, Meta, hosting providers, payment gateways)
• Account bans, suspensions, or restrictions imposed by WhatsApp/Meta on your account
• Messages not delivered, campaigns failed, or contacts lost
• Security breaches, data loss, or unauthorized access to your installation
• Downtime, server crashes, or hosting-related issues

In any event, our total liability shall not exceed the amount paid by you for the product.

6. Third-Party Services & APIs

This product integrates with third-party services including but not limited to WhatsApp Business API (Meta), payment gateways, and cloud services. The buyer acknowledges that:

• We are NOT affiliated with, endorsed by, or officially partnered with Meta/WhatsApp (unless explicitly stated)
• WhatsApp/Meta may change their API, policies, or terms at any time without notice
• Your WhatsApp Business account is subject to Meta's policies — we are not responsible for account bans, restrictions, or policy violations
• We do not guarantee approval of WhatsApp Business verification or Tech Provider status
• API rate limits, messaging limits, and costs from Meta are the buyer's responsibility
• If Meta changes the API in a way that breaks functionality, we will attempt to provide updates but are not obligated to do so indefinitely

7. Updates & Support

7.1 Product Updates

• We provide updates when Meta makes breaking changes to the WhatsApp Cloud API
• Updates are provided for a limited period after purchase — not indefinitely
• Major new features, redesigns, or version upgrades may require a separate purchase
• We are not obligated to provide updates forever — updates are at our discretion

7.2 Support

• Free support is limited to installation assistance only
• Support does not include: customization, bug fixing in your modified code, server management, or business consultation
• Support is provided via WhatsApp during business hours (Mon-Sat, 10 AM - 7 PM IST)
• We reserve the right to refuse support if the code has been heavily modified by the buyer or a third party

8. Refund Policy

• Refund is available ONLY if installation fails despite our support team's assistance, within 7 days of purchase
• Once successfully installed, NO refund will be provided
• Service charges (setup, customization, configuration) are NON-REFUNDABLE once work has begun
• Refer to our Refund Policy page for complete details

9. Buyer's Responsibilities

By purchasing and using this product, the buyer agrees to:

• Use the product in compliance with all applicable laws and regulations
• Comply with WhatsApp/Meta's Business Policy and Commerce Policy
• Not use the product for spam, unsolicited messaging, or illegal activities
• Maintain the security of their server and database
• Keep their hosting, domain, and SSL certificates properly maintained
• Obtain proper consent before messaging contacts (as required by law)
• Not hold KKHS Media responsible for any legal issues arising from their use of the product

10. Indemnification

The buyer agrees to indemnify and hold harmless KKHS Media, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• The buyer's use or misuse of the product
• Violation of WhatsApp/Meta policies by the buyer
• Any legal action taken against the buyer by their customers or third parties
• Non-compliance with applicable laws (IT Act, data protection laws, spam laws)
• Any modifications made to the source code by the buyer or third parties

11. Intellectual Property

• The source code, design, and architecture remain the intellectual property of KKHS Media
• The buyer receives a license to use, not ownership of the intellectual property
• Any trademark, logo, or branding of KKHS Media may not be used without permission

12. Service Packages (Paid Services)

• Service packages (Complete Setup, Agency Setup, Custom Plan) are optional paid services
• Service charges are separate from the source code price
• Timeline estimates are approximate and may vary based on complexity
• Service charges are non-refundable once work has commenced
• Custom development work is billed separately and based on requirements
• We do not guarantee specific results from our services (e.g., guaranteed leads, revenue)

13. Account Suspension & Termination

We reserve the right to suspend or terminate support, updates, or services if:

• The buyer violates these Terms & Conditions
• The buyer uses the product for illegal or unethical purposes
• The buyer redistributes the source code
• The buyer initiates a chargeback/dispute without contacting us first

14. Dispute Resolution

• Any disputes shall first be attempted to resolve amicably through direct communication
• If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India
• These terms are governed by the laws of India

15. Force Majeure

KKHS Media shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, government actions, API changes by third parties, internet disruptions, or hosting provider failures.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms & Conditions, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and KKHS Media regarding the purchase and use of our products.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Continued use of the product or services after changes constitutes acceptance of the new terms.
